Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you and HaviMenu ("we", "us" or "our"). By creating an account or using the HaviMenu platform, websites, apps and related services (together, the "Services") you agree to these Terms.

HaviMenu provides tools for food businesses to create digital menus, generate QR codes, accept customer orders and manage their operations. We may add, remove or modify features from time to time.

You must be at least 18 years old and legally able to enter into a binding contract to use the Services. By using the Services you represent that you meet these requirements.

You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately of any unauthorised use.

New accounts may start with a seven-day free trial. No payment is required to create the trial account. At the end of the trial you must select a paid plan to continue using paid features.

Paid plans are billed quarterly, half-yearly or yearly, in advance. Fees are non-refundable except where required by law. You authorise us to charge your selected payment method for all fees. We may change plan prices with reasonable notice.

You agree not to misuse the Services, including by uploading unlawful, harmful, misleading or infringing content, attempting to breach security, interfering with other users, or using the Services to send unsolicited communications.

You retain ownership of the content you upload to the Services. You grant HaviMenu a worldwide, non-exclusive licence to host, display, reproduce and distribute your content solely as needed to provide the Services.

You are solely responsible for fulfilling orders placed through your public menu, for the accuracy of your menu, prices, availability, allergen information and for complying with all laws applicable to your business.

The Services may integrate with third-party services such as WhatsApp, payment providers and mapping providers. Your use of those services is subject to their own terms and privacy policies.

The Services, including all software, trademarks, logos and content provided by HaviMenu, are owned by HaviMenu or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute or create derivative works.

We may suspend or terminate your access to the Services if you breach these Terms, fail to pay applicable fees, or if we are required to do so by law. You may cancel your subscription at any time; access to paid features ends at the end of the current billing period.

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free or secure.

To the maximum extent permitted by law, HaviMenu will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Services. Our total liability for any claim will not exceed the amounts you paid to HaviMenu in the twelve months preceding the claim.

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles. Disputes arising under these Terms will be resolved in the courts of competent jurisdiction in Lagos, Nigeria.

We may update these Terms from time to time. If we make material changes we will notify you through the Services or by email. Continued use of the Services after the effective date constitutes your acceptance of the updated Terms.
